To the fullest extent permitted by law, Zyptora shall not be liable for any indirect, incidental, special, consequential, or punitive damages, including lost profits, data loss, or business interruption, arising from your use of the Services, even if we have been advised of the possibility of such damages.
Our total liability for any claim arising out of these Terms or the Services shall not exceed the amount you paid us (if any) in the 12 months preceding the claim, or one hundred dollars (US$100) if no payment has been made.
You agree to indemnify, defend, and hold harmless Zyptora and its officers, directors, employees, and agents from and against any claims, damages, losses, and expenses (including reasonable attorneys' fees) arising from your violation of these Terms or your use of the Services.
We may terminate or suspend your account and access to the Services immediately, without prior notice, if you breach these Terms. Upon termination, your right to use the Services will cease immediately. All provisions of these Terms that by their nature should survive termination shall survive.
You may delete your account at any time by contacting us or using account settings.
These Terms shall be governed by and construed in accordance with the laws of the State of California, USA, without regard to conflict of law principles. Any disputes arising from these Terms will be resolved through binding arbitration in San Francisco, California, unless otherwise agreed.
You agree that any claim must be brought individually, not as a plaintiff or class member in any class or representative proceeding.
